Abstract

The problem addressed by this research lies in the absence of a precise definition of a "public employee", compounded by a multiplicity of definitions across various laws and statutes—even within the same jurisdiction. These definitions vary depending on the legislator's intent - specifically, whether the aim is to grant the employee additional powers and authority or to impose greater obligations and responsibilities - thereby complicating the task of defining and identifying exactly who constitutes a public employee. Addressing this issue requires, first, defining the public employee and outlining the essential elements of this definition as set forth in the Palestinian Civil Service Law. It also necessitates identifying the eligibility criteria, selection methods, and appointment procedures that must be followed for an individual to be classified as a public employee under this law.

Research Questions

This research poses the following primary question:

How is a public employee defined under the Palestinian Civil Service Law? What are the essential elements of this definition, and what are the eligibility criteria, selection methods, and appointment procedures required for an individual to be considered a public employee under the law?

Sub-questions Arising from the Main Research Question
The central inquiry regarding the definition of a public employee under the Civil Service Law gives rise to two fundamental sub-questions:

1. What is the definition of a public employee under the Palestinian Civil Service Law, and what are the essential elements of this definition?

2. What are the eligibility criteria, selection methods, and appointment procedures for public service positions under the Palestinian Civil Service Law required for an individual to be considered a public employee?

Research Methodology

Descriptive Analytical, Comparative Study.
