The research problem lies in the absence of an explicit legal provision regulating the public employee's obligation to adhere to the principles of professional neutrality and restraint regarding their opinions and conduct. The Palestinian Civil Service Law failed to include this obligation among the duties imposed on public employees—contrary to the established practice in most comparative legal systems, and even contrary to provisions enacted by the Palestinian legislator in other laws governing specific roles (such as the Security Forces Service Law and the Judiciary Authority Law), which imposed restrictions on military officers and judges to ensure their adherence to the principle of neutrality.
Research Questions
This research seeks to answer the following questions (along with the sub-questions derived from them, as outlined in the research plan):
1. What is meant by the principles of professional neutrality and restraint, what is the relationship between them, and what are their origins and legal bases?
2. To what extent is a public employee bound by the principles of professional neutrality and restraint, and what is the scope of their application regarding the individuals and positions involved, the time and place of application, and situations involving conflicts of interest?
